Terms of Service

Welcome to TriviaForge. These Terms of Service ("Terms") govern your access to and use of the TriviaForge Discord bot, the website at getTriviaForge.com, and any related services (collectively, the "Service"), operated by TriviaForge ("we," "us," or "our").

By inviting the bot to a Discord server, using its commands, or visiting the website, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service, in line with Discord's own Terms of Service. To purchase a Premium subscription, you must be at least 18 years old, or have the consent of a parent or legal guardian who completes the purchase on your behalf.

2. Discord and Third-Party Services

The Service runs on top of Discord and integrates with several third-party providers. Your use of the Service is also subject to:

• Discord's Terms of Service and Community Guidelines
• Stripe's terms for billing and payments

We are not affiliated with, endorsed by, or sponsored by Discord Inc. or Stripe.

3. Your Account and Server

You are responsible for any activity that occurs through your Discord account or on a Discord server you administer where the bot is installed. Server administrators are responsible for ensuring the bot is used in compliance with Discord's policies and applicable law.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or to harass, defame, or harm others
• Submit questions, custom content, or any other material that is illegal, infringing, hateful, sexually explicit, or otherwise inappropriate
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying infrastructure
• Use automated means (other than the intended bot interface) to interact with the Service
• Resell, sublicense, or commercially exploit the Service without our prior written consent

We may suspend or terminate access to the Service, remove the bot from a server, delete user-submitted content, or block individual users at our discretion if these Terms are violated.

5. User-Submitted Content

The Service allows users to submit content, including (but not limited to) questions and answers for the global question pool, custom questions for premium servers, and ratings or reports on existing questions. By submitting content, you:

• Confirm that you have the right to submit it and that it does not infringe any third party's rights
• Grant us a worldwide, royalty-free, non-exclusive, perpetual license to host, store, reproduce, modify, and display the content as part of operating the Service
• Acknowledge that approved global questions may be played on any server using the bot, and that submitted content may be edited, rejected, or removed at any time

6. Premium Subscriptions and Billing

Premium plans are billed through Stripe on a monthly, quarterly, or annual basis depending on the plan you select. By subscribing, you authorize Stripe to charge your chosen payment method on a recurring basis until you cancel.

• You can cancel a subscription at any time from your dashboard's billing portal. Cancellation takes effect at the end of the current billing period; we do not offer prorated refunds for partial periods.
• If a payment fails, premium features may be disabled until the issue is resolved. Custom question data is retained even when premium lapses.
• Pricing and feature availability may change. Material changes affecting active subscribers will be communicated by email or via the website before they take effect.

7. Refunds

Because the Service is digital and access is granted immediately, all purchases are generally final. We may issue a refund at our sole discretion in cases of duplicate billing, billing error, or extended Service outages. Refund requests can be sent to support@getTriviaForge.com.

8. Intellectual Property

The TriviaForge name, logo, website design, source code, and original question content (other than user submissions) are the property of TriviaForge and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to our trademarks or branding without prior written permission.

9. Service Availability

We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time for maintenance, updates, or reasons outside our control (including Discord, hosting, or third-party API outages). We may add, modify, or remove features at any time.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, OR FREE OF ERRORS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRIVIAFORGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $20.

12. Indemnification

You agree to indemnify and hold TriviaForge harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the Service at any time by removing the bot from your servers and discontinuing use of the website. Provisions intended to survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes may also be announced through the bot, the website, or our community Discord.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of those courts.
